Call for Expressions of Interest to join the New Energy Tech Consumer Code Monitoring and Compliance Panel

Expressions of interest to join the Code Monitoring and Compliance Panel have now closed.

The Code

The New Energy Tech Consumer Code (NETCC) sets a minimum standard of service for retailers providing residential and small customers with new energy tech products, systems and services. New energy tech providers that have been admitted by the Administrator into the NETCC program are bound as Signatories to comply with the NETCC when providing new energy tech to their customers. The NETCC has been authorised by the Australian Competition and Consumer Commission (ACCC). Signatories to the Clean Energy Council’s Solar Retailer Code of Conduct are due to be transitioned to the NETCC by 1 February 2023.

The Code Monitoring and Compliance Panel

The Code Monitoring and Compliance Panel (the Panel) is an independent body that will oversee the monitoring and enforcement of compliance with the NETCC. All Panel representatives must be independent of Signatories and the Administrator. The role of the Panel includes:

  • Hearing and arbitrating appeals from any signatory affected by a decision of the Administrator
  • Referring systemic breaches to the relevant regulators
  • Conducting its own inquiries into Code compliance
  • Producing an annual report on the Code's operation, including reporting on Code compliance to enable a periodic assessment of the Code's effectiveness, ensure the Code standards meet the identified objectives and community expectations, and identify systemic issues and areas for improvement
  • Driving best-practice standards in the industry.

All decisions of the Panel are final. Signatories have no right of review beyond the Panel.

Panel members will be appointed for three years and are eligible for reappointment. The Panel will meet at least quarterly. Sitting fees will apply.

Invitation for expressions of interest

The NETCC Council is inviting expressions of interest for membership of the Panel from:

  • Industry representatives with experience in the relevant new energy technology outlined in the Code.
  • Consumer representatives with relevant experience and knowledge in areas such as consumer advocacy, consumer protection, consumer law.
  • Independent experts with relevant experience, such as academics in the field of new energy tech, experts in the National Credit Code.
