ACCC formally authorises NETCC, transition to updated Code begins

Published on - 24 Sep 2026

The ACCC has formally reauthorised an updated version of the New Energy Tech Consumer Code (NETCC) for a further five years. The next stage will be to transition all Approved Sellers to the updated Code.

In its determination, the ACCC found that the NETCC has resulted, and is likely to continue to result, in public benefits. Reauthorisation means the NETCC can continue delivering these benefits for a further five years.

The updated Code, produced as part of the authorisation process, contains changes that strengthen its benefits for consumers when buying new energy tech and clarifies requirements for Approved Sellers.

Key changes include:

  • Clarifying what counts as a false or misleading claim: The commitment not to make false or misleading claims extends to all statements, not just those made in advertising and promotions.
  • Additional quoting disclosures: Quotes for bespoke designs or initial contract deliverables must specify any applicable fees and the circumstances in which those fees are refundable.
  • Clearer refund and termination terms: Some types of non-refundable fees may be deducted from a refund owed to a customer.

New Energy Tech Approved Sellers will now begin the process of transitioning to the updated Code, which will come into effect on 1 December 2026.
