NETCC Council Meeting - November 2025

This is a summary of the meeting of the NETCC Council held on 20 November 2025.

Communiques of each meeting are produced so that stakeholders can be informed about the work of the Council and its implementation of the Code.

Administrator update

2026 independent review

Proposals for conduct of the review have been received. The NETCC Monitoring and Compliance Panel will agree on the final vendor and advise Council of progress of the procurement process.

Sales and installation agreement

Work on this model agreement will commence in the new year.

Application trends

  • There were just over 2060 signatories as of the meeting date, with notable growth in South Australia, due to the SA Powering Business Grant offer which expired 31 October 2025.
  • Application numbers remain steady, and the assessment team are maintaining an initial application turnaround of under 10 days.

Compliance trends

  • 100% of new cases in October 2025 were complaint cases
  • 111 in-progress cases opened as of 4 November 2025. Of these 111, 30% have proceeded to allegation letters or letters of outcome (later stage of the investigation).
  • 9% of breaches in October were recorded against quote/contract sections of the code (clauses 9-23).
  • The Council asked to see complaint trends over time mapped to signatory uptake.

Case review

  • The consumer contracted a third-party builder to supply them with new energy tech through a NETCC Seller.
  • As the contract is not between the consumer and the NETCC Seller the consumer is not protected under the code.
  • The Chair of the Compliance and Monitoring Panel will address the consumer’s escalation on behalf of the panel, and it was recommended by the Panel to flag the signatory company for an audit.
  • Council noted that based on this case review, further consideration is required, as similar issues will likely increase with the increase in consumer purchase of solar and batteries. The Administrator will consider this issue as part of the NETCC strategy.

NETCC ACCC Authorisation submission

The Council discussed the key themes of the submissions made to the ACCC regarding the Authorisation application. It was agreed that the response to the ACCC should focus on key issues and recommendations that can bring about positive enhancements for the NETCC.

Other business

2026 meeting schedule

Council supported an in person joint meeting with the Monitoring and Compliance Panel. The Administrator suggested holding the joint meeting in May 2026 to align with having a draft independent review report and recommendations. The Administrator to circulate options for 2026 meeting dates.

Other business

The Chair thanked the Code support team for all their work during the year, particularly in view of the Code reauthorisation and the significant increase in signatory applications and compliance work.
