As the NETCC is approaching three years in operation an independent review is required and a Terms of Reference (ToR) document has been drafted by the Compliance and Monitoring Panel Chair.
The ACCC advised that the reauthorisation application would be up on the public register the week of 1 September 2025.
There were just over 1,900 signatories as of the meeting date, with notable growth in Western Australia and New South Wales. This growth is attributed to state and local government incentive programs. The application rate has experienced significant increases, peaking in June 2025 at 140 applicants. The assessment team have been maintaining processing time at under 3 weeks. Where applications have not been approved, this is mostly due to the applicant being unwilling to meet the Codes requirements, or unresponsive to the assessment team’s letter of amendments/outreach.
NETCC complaints received have increased over the first two months of Q1 FY26, at 50 per month. The monthly average has increased by a factor of 2.7 compared to the monthly average of FY25, which was 18 per month. Almost 50% of complaints received in Q1 of FY26 are from Victorian consumers. No trends or changed activity are known to have occurred in Victoria to explain the rise, and the team will continue to monitor over the coming months.
The audit program has reached its first year in operation, with strong audit activity. 152 audit questionnaires were issued in Q1 of FY26, putting the total number of audit questionnaires issued since commencement of the program at 414, covering 26% of signatories1. A new tranche of robust audit cases, which review recent sales contracts, was also administered, bringing the total to 43 for the audit program, covering 3% of signatories2. The audit program will now undergo a review process to ensure it remains fit for purpose.
Given the influx of complaints and steady application numbers, the Administrator is undergoing workforce planning to ensure teams are working at a safe capacity level, and without compromise to the program.
The CEC Interim COO presented the end of year results and budget for FY26. The Administrator proposed no fee increase for signatories for the following year, which was supported by Council.
The Administrator presented a formal proposal for a model sales and installation agreement to assist retailers and reduce non-compliance issues with contract requirements. The NETCC Council approved the proposed agreement cost model.
The next meeting is scheduled for November 2025.
